These Terms and Conditions (hereinafter the "Terms") govern access to and use of the website www.jobwave.it (hereinafter the "Site"), the JobWave.it mobile application for iOS and Android (hereinafter the "App"), and all services connected to them (collectively, the "Service").

By accessing the Site, downloading the App or using any functionality of the Service, the user (hereinafter the "User" or "you") declares that they have read, understood and fully accepted these Terms and our Privacy Policy. If you do not accept these Terms, you must not use the Service.

1. Definitions

• "JobWave", "we", "our": the owner of the Service.
• "Service": the website, the App and all the features offered, including the publication of listings, job searching, the sending of applications, comments, push notifications and the JobWave Star programme.
• "User": any natural or legal person who uses the Service, whether registered or not.
• "Listing": any content published on the Site or the App relating to job offers or requests in the nautical/yachting sector.
• "User Content": texts, images, CVs, messages, comments, reactions and any other material uploaded or published by the User.
• "JobWave Star": the optional programme supporting the Service that offers additional benefits, described in detail on the dedicated page and in section 10 of these Terms.

2. Age and eligibility requirements

The Service is intended exclusively for adult users (18 years of age) or, for users residing in countries where applicable law allows it, for persons aged 16 or over with the consent of the holder of parental responsibility. By using the Service, you declare that you are of the required age and are fully capable of entering into legal obligations.

3. Registration and account

• To access certain features, you must create an account by providing a valid email address.
• Authentication takes place via magic link (website) or an OTP code sent by email (App).
• The User is responsible for the safekeeping of their own devices and access codes.
• The User undertakes to provide information that is true, accurate and up to date.
• JobWave reserves the right to suspend or close accounts that use false data, names that are not permitted (e.g. "admin", "jobwave", "staff", "administration") or that violate these Terms.

4. Services offered

JobWave offers a platform for the publication and browsing of job listings in the nautical sector. The main services include:

• free publication of listings;
• search and display of listings;
• sending of applications with attached CV to advertisers;
• comments and reactions on News-type listings;
• push notifications on mobile devices;
• the optional JobWave Star programme.

5. Publication of listings

• Listings must be truthful, lawful and refer to real job positions in the nautical sector.
• It is not permitted to publish listings that are discriminatory, offensive, misleading, spam, pyramid or multi-level schemes, that require payments from the prospective worker, or that violate third-party rights.
• JobWave reserves the right to moderate, reject, modify or remove any listing it deems inappropriate, without obligation to provide reasons.
• The first listing published from a new email address may be subject to moderation before approval.
• Listings may be shared on JobWave's official social media channels to increase their visibility.
• Images uploaded to listings are hosted on Imgur; the User accepts Imgur's terms of service.

6. Applications

• Applications are sent directly to the advertiser through the Service.
• The User is responsible for the information entered and the files attached.
• JobWave is not a party to the relationship between candidate and advertiser and does not guarantee the outcome of an application.
• To prevent abuse, limits are in place on the number of applications that can be sent from the same IP address within a given time frame.

7. Comments and social interactions

• Comments are available on News-type listings.
• The User can express reactions (Like, Great, Dislike).
• It is forbidden to publish comments that are offensive, defamatory, spam or that violate the law. JobWave may remove comments and reactions and suspend their authors.

8. Prohibited conduct

The User undertakes not to:

• use the Service for unlawful or unauthorised purposes;
• enter false data or impersonate third parties;
• send spam, unsolicited commercial messages or malware;
• violate the intellectual property of JobWave or of third parties;
• carry out web scraping, reverse engineering or cyberattacks;
• circumvent security, moderation or antispam verification systems;
• publish content that promotes discrimination, violence, illegal activities or adult content.

9. Intellectual property

• The trademarks, logos, trade names, source code, texts and images of JobWave are the exclusive property of the owner or its licensors.
• The User grants JobWave a non-exclusive, royalty-free, worldwide and sub-licensable licence to reproduce, modify, publish and distribute User Content solely for the enjoyment of the Service.
• The User declares that they hold all the necessary rights to the User Content they upload.

10. JobWave Star

JobWave Star is an optional programme supporting the Service. Full details are available on the dedicated JobWave Star page, and the following general conditions apply under these Terms:

• JobWave Star is not a subscription: it does not provide for automatic renewal.
• It is possible to make only one donation in support of Star every 30 days per user.
• Payments on the website are handled by PayPal.
• JobWave does not store sensitive payment data.
• Refunds are generally excluded, except in the case of failure to activate Star status due to technical causes attributable to JobWave.
• Star status is personal and non-transferable to other email addresses.
• JobWave reserves the right to modify, suspend or terminate the Star programme at any time, with reasonable prior notice to active users.

11. Push notifications

The App may send push notifications relating to new listings, news or service communications. Notifications require express consent via the device's operating system and can be disabled at any time from the App or device settings.

12. Links to third-party sites

The Service may contain links to third-party websites or services (e.g. social networks, PayPal, company websites). JobWave is not responsible for the content, privacy practices or terms and conditions of such third-party sites. We invite you to read their respective policies.

13. Limitation of liability

• JobWave provides the Service "as is" and does not guarantee that it is always available, error-free or 100% secure.
• JobWave is not responsible for the truthfulness, quality or lawfulness of listings published by Users.
• JobWave is not responsible for damages arising from contractual or non-contractual relationships between advertisers and candidates.
• To the maximum extent permitted by applicable law, JobWave's liability is limited to direct and foreseeable damages.

14. Indemnification

The User undertakes to indemnify and hold harmless JobWave, its legal representatives, employees and collaborators from any claim, damage, loss or expense (including legal fees) arising from the violation of these Terms or from the publication of unlawful User Content.

15. Suspension and closure of the account

JobWave may suspend or close an account, remove content or limit access to the Service in the event of a violation of these Terms, upon reports from third parties or for security reasons. The User may request the deletion of their account at any time.

16. Changes to the Terms

JobWave may modify these Terms at any time. The changes will take effect from the date of updated publication. Continued use of the Service after the changes will constitute acceptance of the new Terms.

17. Applicable law and competent jurisdiction

These Terms are governed by Italian law. For any dispute arising from these Terms, the court of the place of residence or domicile of the consumer User shall have jurisdiction, or the Court of Turin for non-consumer users, unless otherwise required by mandatory law.
